Terms and Conditions
- These terms and conditions relate to your application to participate in a dance-based talent competition with the working title of "Got to Dance" (the "Programme"), which Princess Productions Limited (the "Producer") intends but does not undertake to produce for British Sky Broadcasting Limited ("Sky").
- You acknowledge and agree to abide by the rules, regulations, terms and conditions for this competition as determined by the Producer (the "Rules") and you acknowledge that the Rules may be changed (whether verbally, in writing or otherwise) by the Producer at any time in its sole discretion. The Producer's decision regarding any and all elements of the application process and Programme shall be final and binding and no correspondence shall be entered into.
- The Producer and/or any of its respective licensees, assigns, parents, affiliated and subsidiary companies do not accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any aspect of the online application system which may result in any applications not being properly received.
- The Producer will not be able to reply to all applicants individually. You will only hear from us if you have been short listed to take part in the auditions. The completion of an Application Form does not in any way constitute an offer to participate in the Programme or to audition to appear.
- Attendance at auditions at all stages of the competition is by invitation only and the date and time of your auditions/performances will be at the discretion of the Producer and subject to child performance licensing and working time regulations.
- You must be a UK or Irish resident in good health and aware of no reason why you should not be able to dance as part of this competition. You will, upon request, provide the Producer with supporting documentation in order to substantiate this, and will immediately notify the Producer of any change in your immigration or residential status.
- You will be required to bring a valid form of photographic identification to the auditions with you, in the form of a passport or full birth certificate only. For the avoidance of doubt, driving licenses will not be accepted.
- Employees, officers, directors and agents of Sky or the Producer and/or of any of their respective licensees, assigns, parents, affiliated and subsidiary companies and the immediate family or members of their households are not eligible to appear on the Programme or participate in this application process.
- Applications will only be considered if the Application Form is properly completed. If you are entering as a group, each member of the act's personal details must be correctly filled in separately where indicated.
- If you are under 18 years old you must be accompanied by your parent or legal guardian at the audition, and will be required to bring proof of age with you.
- You must disclose all details of any and all criminal/civil actions pending against you currently and/or served against you and/or any unspent convictions, and you shall notify the Producer immediately in the event that any criminal charges are brought against you or if any information provided in your application becomes inaccurate between now and the date of first transmission of the last episode of the Programme.
- You hereby agree that if you are short-listed by the Producer, you agree to authorise the Producer to conduct background checks (including but not limited to Criminal Records Bureau (CRB) checks) in order to verify any of the information provided herein.
- All participants in the competition will be selected at the sole discretion of the Producer whose decision will be final. All decisions by the Producer concerning selection of the participants are final and applicants agree not to challenge or appeal against those decisions.
- The information you supply on this form (including your personal details):
- may be included in a database compiled for this Programme and will only be used for the purposes related to the production or promotion of the Programme;
- may be used for inclusion and/or read out in the Programme ; and
- will not be supplied to third parties other than as is reasonably necessary for the purposes of producing and/or promoting the Programme.
- All information supplied (including personal details) in your application or otherwise provided must be truthful, accurate and in no way misleading. The Producer reserves the right to disqualify you if you have supplied untruthful, inaccurate or misleading personal details and/or information, have failed to abide by the rules or are in breach of these terms and conditions.
- You will not, without the Producer's prior written consent disclose, publicise or discuss with any third party (which shall include on any social media websites such as facebook, twitter and myspace) any information relating to your application or the Programme, your appearance, the production team or any participants in the Programme nor any other information which may come to your attention (including without limitation in relation to Sky, the Producer or otherwise) save where such information is already public knowledge.
- In the event that you are called for an audition you (and anyone you intend to bring with you to the audition) may be filmed doing so and prior to and as a condition for your participation, you will be required to sign a separate Contributor Agreement, Health Declaration and any other further agreements as may be requested, with the Producer. This Agreement will provide that in consideration of your participation in the Programme, we will own all of the rights in the Programme including your contribution which will be freely available for broadcast and all other media purposes without any payment to you.
- In the event the Producer wish to use the materials submitted by you (including without limitation any photographs or any video submitted) (the "Materials") as part of and/or separately from the Programme you hereby:
- grant to the Producer (and its licensees and assigns) all necessary rights and consents for the full period of copyright (and afterwards so far as possible in perpetuity) to use at the Producer's sole discretion the Materials in any way and in any media and means;
- warrant that you own and can grant all rights in the Materials;
- that the Producer shall be free to assign or license their rights in the Materials without my prior consent and you shall not be entitled to injunct or restrain the transmission or use of the Materials or any programme (or any part of it or them); and
- irrevocably and unconditionally waive any so-called "moral rights" in the Materials or any such programme (as set out in section 77 and section 80 of the Copyright, Designs and Patents Act 1988 or otherwise) as you now have or may acquire in relation to the photograph(s) or such programme.
