Terms and Conditions

  1. Shine Limited ("Shine") will be unable to reply to all applicants individually. You will only hear from us if you have been short listed to take part in the auditions. This Application Form does not in any way constitute an offer to participate in the series or to audition to appear.
  2. You must be a UK or Irish resident in good health and aware of no reason why you should not be able to dance as part of this competition. You will, upon request, provide Shine with supporting documentation in order to substantiate this.
  3. You will be required to bring a valid form of photographic identification to the auditions with you.
  4. Employees, officers, directors and agents of British Sky Broadcasting Limited ("Sky") or Shine and/or of any of their respective licensees, assigns, parents, affiliated and subsidiary companies and the immediate family or members of their households are not eligible to appear on the Programme or participate in this application process.
  5. Applications will only be considered if this form is properly completed. If you are entering as a group, each member of the act’s personal details must be correctly filled in separately where indicated.
  6. If you are under 18 years old you must be accompanied by your parent or legal guardian at the audition.
  7. You must disclose all details of any and all criminal/civil actions pending against you currently and/or served against you and/or any unspent convictions.
  8. All participants in the competition will be selected at the sole discretion of Shine whose decision will be final. All decisions by Shine concerning selection of the participants are final and applicants agree not to challenge or appeal against those decisions.
  9. The information you supply on this form (including your personal details):
    1. may be included in a database compiled for this series and will only be used for the purposes of selecting participants for this;
    2. may be used for inclusion and/or read out in the series of television programmes produced for initial transmission by Sky (the "Series"); and
    3. will not be supplied to third parties other than as is reasonably necessary to select contestants and produce the Series.
  10. All information supplied (including personal details) in your application or otherwise provided must be truthful, accurate and in no way misleading. Shine reserves the right to disqualify you if you have supplied untruthful, inaccurate or misleading personal details and/or information, have failed to abide by the rules or are in breach of these terms and conditions.
  11. You will not, without Shine’s prior written consent disclose, publicise or discuss with any third party any information relating to your application or the Programme, your appearance, the production team or any participants in the Programme nor any other information which may come to your attention (including without limitation in relation to Sky, Shine or otherwise) save where such information is already public knowledge.
  12. Applicants agree that if they are short-listed by Shine they agree to authorise Shine to conduct background checks (including but not limited to Criminal Records Bureau (CRB) checks) in order to verify any of the information supplied.
  13. In the event that you are called for an audition you (and anyone you intend to bring with you to the audition) may be filmed doing so and prior to and as a condition for your participation, you will be required to sign a separate Contributor Agreement and Health Declaration with Shine. This Agreement will provide that in consideration of your participation in the Series, we will own all of the rights in the series including your contribution which will be freely available for broadcast and all other media purposes without any payment to you.
  14. In the event Shine wish to use the materials submitted by you (including without limitation any photographs or any video submitted) (the "Materials") as part of and/or separately from the Series you hereby:
    1. grant to Shine (and its licensees and assigns) all necessary rights and consents for the full period of copyright (and afterwards so far as possible in perpetuity) to use at Shine’s sole discretion the Materials in any way and in any media and means;
    2. warrant that you own and can grant all rights in the Materials;
    3. that Shine shall be free to assign or license their rights in the Materials without my prior consent and you shall not be entitled to injunct or restrain the transmission or use of the Materials or any programme (or any part of it or them); and
    4. irrevocably and unconditionally waive any so-called "moral rights" in the Materials or any such programme (as set out in section 77 and section 80 of the Copyright, Designs and Patents Act 1988 or otherwise) as you now have or may acquire in relation to the photograph(s) or such programme.
  15. The closing date for applications shall be 30th October 2009.
