This is an application to be included as a member of the so-called 'Supergroup' in the television programme which Shine Limited ("Shine") proposes but does not undertake to produce for Channel 5 Broadcasting Ltd ("Five") provisionally entitled "Don't Stop Believing - Series 1" ("the Programme").
Shine will be unable to reply to all applicants individually. You will only hear from us if you have been short listed to take part in the Programme. This application form does not in any way constitute an offer to participate in the Programmme or to audition to appear. 'Supergroup' members may be selected from a variety of sources and you understand that the final 'Supergroup' may or may not be selected from those who apply through this process.
You must be a UK resident aged 14 or over on the date of this application, in good health and aware of no reason why you should not be able to perform as part of the Programme. You will, upon request, provide Shine with supporting documentation in order to substantiate this.
You will be required to provide a valid form of photographic identification if invited to participate in the Programme.
Employees, officers, directors or agents of, or anyone previously employed or engaged by, Five or Shine and/or of any of their respective licensees, assigns, parents, affiliated and subsidiary companies and the immediate family or members of their households are not eligible to participate.
Applications made using this form will only be considered if this form is properly completed.
If you are under 18 years old you must have the permission of, and be accompanied by your parent or legal guardian if invited to participate in the Programme and may be required to procure they complete additional paperwork on your behalf in order for you to be considered as a participant in the Programme.
You must disclose all details of any and all criminal/civil actions pending against you currently and/or served against you and/or any unspent convictions.
All participants in the Programme will be selected at the sole discretion of Shine whose decision will be final. All decisions by Shine concerning selection of the participants are final and applicants agree not to challenge or appeal against those decisions.
The information you supply on this form (including your personal details):
may be included in a database compiled for the Programme and will be used for the purposes of selecting participants for this programme;
may also be used for inclusion and/or read out in Programme produced for initial transmission by Five; and
will not be supplied to third parties other than as is reasonably necessary to select participants and produce the Programme unless you have expressly consented to us doing so by answering the question "Would you like us to contact you about future series and other opportunities?" with "Yes", where indicated elsewhere on this Application Form.
All information supplied (including personal details) in your application or otherwise provided must be truthful, accurate and in no way misleading. Shine reserves the right to disqualify you if you have supplied untruthful, inaccurate or misleading personal details and/or information, have failed to abide by the rules or are in breach of these terms and conditions.
You will not, without Shine's prior written consent disclose, publicise or discuss with any third party any information relating to your application or the Programme, your appearance, the production team or any participants in the Programme nor any other information which may come to your attention (including without limitation in relation to Five, Shine or otherwise) save where such information is already public knowledge.
You agree that if you are short-listed to appear in the Programme, Shine may conduct background checks (including but not limited to Criminal Records Bureau (CRB) checks) on you in order to verify any of the information you have supplied.
In the event that you are invited to participate in the Programme, prior to and as a condition for your participation you will be required to sign a separate Contributor Agreement and Declaration of Health with Shine. The Contributor Agreement will provide that in consideration of your participation in the Programme, Shine will own all of the rights in the Programme including the contribution which will be freely available for broadcast and all other media purposes without any further payment to the participant.
In the event Shine wish to use the materials submitted by you (including without limitation any photographs or any video submitted) (the "Materials") as part of and/or separately from the Programme you hereby:
grant to Shine (and its licensees and assigns) all necessary rights and consents for the full period of copyright (and afterwards so far as possible in perpetuity) to use at Shine's sole discretion the Materials in any way and in any media and means;
warrant that you own and can grant all rights in the Materials;
that Shine shall be free to assign or license their rights in the Materials without your prior consent and you shall not be entitled to injunct or restrain the transmission or use of the Materials or any programme (or any part of it or them); and
irrevocably and unconditionally waive any so-called "moral rights" in the Materials or any such programme (as set out in section 77 and section 80 of the Copyright, Designs and Patents Act 1988 or otherwise) as you now have or may acquire in relation to the photograph(s) or such programme.
The closing date for applications is the week commencing 15 August 2010, although entries will be selected for possible inclusion in the Programme prior to the closing date.
Shine reserves the right to alter or amend these terms and conditions at any point during the application, audition and/or filming stages of the Programme.
